These Terms of Service ("Terms") govern your use of the Andon Alert service ("Service") operated by Wetfish Limited ("we", "us", "our") at andonalert.net. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Andon Alert is a virtual Andon system that provides real-time factory alerting and communication tools. The Service enables factory workers to report production issues and enables supervisors and managers to receive notifications and track resolution of those issues. The Service includes web-based workstation interfaces, supervisor dashboards, and SMS/email notifications.
Access to Andon Alert requires an invitation from a factory administrator. To register, you must provide accurate and complete information, including your name, email address, phone number, and a valid invite code. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
You agree to use Andon Alert only for its intended purpose as a factory alerting and communication tool. You agree not to:
Andon Alert delivers notifications via SMS as part of its core functionality. By registering and providing your phone number, you consent to receive SMS messages as described in our SMS Terms & Conditions. Message and data rates may apply. You can opt out of SMS messages at any time by replying STOP to any message.
Andon Alert is provided to you through your employer's subscription. Your employer's factory administrator controls the configuration of workstations, alert rules, shift assignments, and user access. Your employer may have access to your alert activity, response times, and other usage data generated through the Service.
Your use of Andon Alert may be subject to additional workplace policies established by your employer. Wetfish Limited is not a party to your employment relationship and is not responsible for workplace policies or decisions made by your employer based on data from the Service.
We strive to maintain reliable service availability but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any damages resulting from service interruptions or delays in message delivery.
Andon Alert is a supplementary communication tool and should not be used as the sole safety or emergency notification system. Your facility should maintain appropriate safety protocols independent of this Service.
All content, features, and functionality of the Andon Alert service — including but not limited to software, text, graphics, logos, and design — are the property of Wetfish Limited and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during the term of your employer's subscription.
To the maximum extent permitted by law, Wetfish Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. This includes, without limitation, damages for lost profits, production losses, data loss, or business interruption.
Our total liability for any claim arising from the Service shall not exceed the amount paid by your employer to Wetfish Limited for the Service during the twelve (12) months preceding the claim.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific requirements or that SMS messages will be delivered without delay.
Your access to the Service may be terminated by your employer's factory administrator at any time by removing your account. Wetfish Limited may also suspend or terminate your access if you violate these Terms or if your employer's subscription ends. Upon termination, your right to use the Service ceases immediately.
We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions.
